Terms and Conditions

These terms and conditions apply to contracts for the sale of
products on the website www.oleificioolma.it (the "Store”) made between Collegio Toscano degli Olivicoltori OL.MA. s.a.c., Montepescali Stazione (GR), Loc. Madonnino 3, Tax code and VAT number 00127960532 (“OL.MA.”) and the consumer (“Customer”).

The purchase of a product implies the full and unconditional acceptance of these terms and conditions of sale (“Terms and Conditions”). The Terms and Conditions will remain in full force and effect until varied and/or amended by OL.MA. Amendments or additions to the Terms and Conditions will take effect from the date of publication on the Store and will apply to all sales made from that
date onwards. The updated version of the Terms and Conditions is the one
published in the relevant section of the Store.

All products on sale have a guaranteed minimum 12-month expiry
period, from the date of purchase. If the expiry date is less than 12 months,
the Customer will be informed by e-mail when the order is confirmed.

1 - Scope of application

The Store offers the e-commerce of tins and bottles of olive oil and related products.

Sold-out products will remain unavailable until fresh stocks come in. If a
product has sold out, it is no longer available.

OL.MA. may accept Customer orders up to the quantities of product available.
Therefore, OL.MA’s acceptance of the Customer’s offer to purchase is subject to availability of the product. OL.MA. will inform the Customer immediately of any
unforeseen stock shortages due to excess demand or other reasons.

3 - Method of Payment

The following payment methods are available:

Credit card:

When paying by credit card you will be redirected to the website
of Consorzio Triveneto. Payments are secure and made through SSL active
security systems. Credit card payments allow for faster fulfilment of orders.

Bank transfer:

If you choose to pay by bank transfer, once the order has been
placed you will receive an email containing details of the bank account to
which the transfer should be made. To speed up the fulfilment of your order,
you can send the order confirmation using the “Contact Customer Service” tab on your account page.

If you do not send the order confirmation to Customer Service, the order will
be fulfilled when the amount has been credited to our current account.

Cash on delivery:

Cash on delivery is only possible for addresses in Italy. You can pay the courier directly on receipt of the goods. In this case, a fee of € 8.00 applies.



The acceptance of cookies is essential when making any purchase or for
registering on this website.

4 - Prices

All prices are indicated in euros, inclusive of VAT. The prices
shown are those applicable at the time the order is registered. No difference
will be recognised if there is any reduction in the value of the order.

OL.MA reserves the right to update the prices at any time.

The costs of delivery are indicated on the Website.

5 - Acceptance of Terms and Conditions

The Customer's approval of the order implies the full and unconditional acceptance of the Terms and Conditions. To validate the order, the Customer must click on ‘Confirm’. OL.MA will send an email confirming receipt of the order proposal, to the email address given by the Customer. OL.MA will then send another email to confirm the order proposal. The contract is deemed to be formed when the Customer receives the confirmation of order.

6 - Delivery

The products will be delivered to the address given by the Customer at the time of purchase, provided that the details have been entered
accurately and all the information required to fulfil the delivery has been
provided.



Delivery times and hours:



- up to 5 working days for deliveries within Italy, by express courier



OL.MA. declines all liability for non-delivery and/or late delivery of the
goods due to non-operation or partial operation of the postal service and/or in
cases of force majeure, such as natural events, strikes, traffic congestion or
particularly busy periods.



If the type, quality or quantity of products delivered do not correspond to the order, the Customer can report any defects within eight (8) days of opening the box.

7 - Right of cancellation

E-commerce sales are governed by Articles 47, 48 and 64 of
Legislative Decree 206/2005 (Consumer Code). The consumer has a legal right to
cancel the contract, return the products purchased and obtain a full refund
within 10 days of receiving the product.



The Customer can exercise the right of cancellation by sending written notice
by registered post or by telegram, telex, email or fax to the following

Under Article 55 (2) of the Consumer Code, the Customer does not
have a right of cancellation in the following cases:



- the products were custom made or personalised, or due to their nature they
cannot be re-shipped, or they are highly perishable and subject to rapid
deterioration;

The Customer cannot exercise the right of cancellation if the
product is not intact, or if:

the original packaging is missing;

some parts of the product are missing;

the product has been damaged by the Customer.



The right of termination is reserved exclusively for consumers (individuals
buying the goods for purposes unrelated to their professional activity, trade
or business) and therefore it cannot be exercised by persons or legal entities
acting for purposes related to their profession or occupation.

7.1 - Post-cancellation returns

To return the goods after exercising the right of cancellation, the Customer has
ten (10) days from delivery of the product. Goods must be shipped to:

The products must be adequately protected in their original packaging, in
perfect condition for resale (not worn, dirty or damaged by the Customer).

The sender bears the full cost and risk of returning the products.



Reimbursements must be made within 30 (thirty) days from the date on which
OL.MA receives the goods, after the Customer’s IBAN has been provided.
Reimbursement includes the purchase price of the products ordered and the
delivery costs incurred. It does not include the shipping costs for returning
the product, which are payable by the Customer. The reimbursement will be made in the form of a credit paid into the Customer’s bank account.

8 - Responsibility

All products conform to current Italian law.

Photographs and text are given as examples only and may differ from the
product. They are subject to change without notice. Therefore, OL.MA declines all liability for any errors deriving from illustrative photos or text.



OL.MA. may not in any case be held liable for any breach of contract in the
event of product shortages, unavailability, force majeure, faults,
interruptions, total or partial strikes affecting postal and transport services
and/or telecommunications.

9 - Intellectual Property

All the information indicated in the Store, all the brands displayed in the Store,
all the related software and/or technologies and all other parts of the
Websites are reserved and protected. The reproduction of trade marks and logos used in the Store is prohibited. The Customer also undertakes not to copy,
modify, translate, reproduce, circulate, sell, publish, promote or diffuse in
any other way, in any format whether electronic or otherwise, all or part of
the information present on the Store.

10 - Customer’s obligations

The Customer declares and warrants: (i) that they are a consumer as defined in Art. 3 of the Consumer; (ii) that they are over the age of majority; (iii) that the
details provided for the execution of the Contract are true and accurate.

11 - Privacy

Information required in accordance with Italian Legislative Decree 196/2003 (“Italian DataProtection Code”)

Collegio Toscano degli Olivicoltori OL.MA. s.a.c. takes the
protection of personal data very seriously. We therefore wish to inform you about the purpose, method and scope of the processing of your personal data, and inform you of your rights pursuant to Art. 13 of Italian Legislative Decree 196/2003.

In order to offer a customised service through our e-commerce site, Collegio Toscano degli Olivicoltori OL.MA. s.a.c. as the data controller is required to process some identifying details.

11.1 - Browsing data

During normal use, the computer systems and software procedures used on this Website will acquire personal data, the transmission of which is implicit in Internet communication protocols.

necessary to provide you with the requested services.

The data will not be circulated but they may, where necessary to provide the

12 - Jurisdiction

This contract is governed by the laws of Italy. The language of this contract is
Italian. For any dispute, the Court of Grosseto will have jurisdiction.
